Fly tipping in Westminster carries a £600 fine, £400 if paid within 10 days. How to report it, and how a cheap clearance firm can cost you £500.

Fly tipping in Westminster carries a fixed penalty of £600, or £400 if paid within 10 days, on the council’s published penalty schedule. To report it, use the Report It form for illegal dumping on the council’s site. Fix My Street is no longer an option: the council says it has stopped taking reports from it.

This is an offence the council actively pursues. It said in January 2026 that it had issued 941 fixed penalties for fly-tipping, by residents and businesses, in the 2025-26 financial year so far.

What counts as fly tipping

Westminster defines it as the illegal dumping of waste, from a single bin bag to large quantities dumped from vehicles. Mattresses, furniture, fridges, microwaves and other bulky items left on the street all count.

How to report it

Report it through Report It, choosing “Illegal waste dumping or fly-tipping”. There is a separate option for dumped bin bags and another for dumped cardboard boxes.

The council asks you not to touch the waste or put yourself at risk, and not to disturb the site, as it may hold evidence. Have these details ready:

  • The day, date and time you saw it
  • The exact location
  • What you saw, and how many people were involved
  • What they looked like
  • What was dumped, and how much
  • Any vehicle: make, colour and registration number

We could not find a published target for how quickly a report gets cleared, so we are not quoting one.

For larger dumps, GOV.UK lists the Environment Agency’s 24-hour incident hotline on 0800 80 70 60, which covers hazardous or industrial waste and organised waste crime. You can report large-scale dumping anonymously to Crimestoppers on 0800 555 111.

The fines

Offence Fine If paid within 10 days Maximum on conviction
Fly-tipping (residents or businesses) £600 £400 12 months in prison or an unlimited fine
Household duty of care £500 £300 £5,000, or an unlimited fine on indictment
Commercial duty of care £300 £180 £5,000, or an unlimited fine on indictment
Failing to show a waste carrier’s licence £300 £180 Unlimited
Leaving litter £200 £120 £2,500

The full amount applies if paid within 14 days. These are the figures in the schedule the council links from its fixed penalty page, a document dated April 2024. Check the notice itself for what you owe, because it sets out the amount and the deadline.

The council says offenders will normally get a fixed penalty, but that it can prosecute. Courts can also take away the rights to a vehicle used in the offence, and the person controlling a vehicle can be prosecuted even if only the vehicle, and not the driver, can be identified.

The fine people do not expect: paying a man with a van

You can be fined even if you never touched the dumped waste. Under the household duty of care, you must take reasonable steps to make sure that your waste goes only to someone authorised to take it. If a cheap clearance firm found on social media dumps your sofa in an alley and it is traced back to you, you are the one who may face the £500 penalty.

Before you hire anyone, check they are a registered waste carrier and ask where the waste is going. Be wary of a cash-only price well below what others quote.

Bags left out at the wrong time

Putting a bag out early is not treated in the same way. Westminster’s process for putting household waste out at the wrong time, or in the wrong container, starts with a formal warning that lasts for 12 months. A notice of intent to impose a financial penalty comes next, and you have 28 days to respond. A final notice with a penalty follows, which you can appeal to a First-tier Tribunal within 28 days. This applies where you have been served with a notice setting out those requirements.

How to get rid of bulky waste legally

Westminster has no permanent recycling centre of its own, but the legal options are not as limited as that sounds:

  • Bulky waste collection: the council collects up to six items for a set fee, and it is free if you receive Housing Benefit or Council Tax Support.
  • Smugglers Way tip: Westminster residents can use the site in Wandsworth.
  • Community Mobile Recycling Centre: a one-day pop-up that takes bulky items for free on published Saturdays. Our bulky waste page has the details.
  • Hazardous waste: household chemicals and asbestos go to a free collection run by the City of London. The council’s hazardous waste page explains how to book it, and has separate advice for paint.

The council says it spends around £1 million a year removing waste that was not disposed of correctly, and that it has been trialling CCTV to catch fly-tippers.

If you get a fine you think is wrong

Payment is online, in full: the council does not take part payments or payment plans. There are no formal grounds for appeal, but you can contest the notice in court. The council also offers an informal challenge if you believe the notice contains a material defect, such as a wrong date. It suspends the notice during the review, and you get the outcome by email.

Not knowing the law, a first offence and a lack of signs are all listed as things that are not grounds for cancellation.
